Terms of Service
1. Acceptance of Terms and Scope of Application
These Terms of Service (“Terms”) govern your access to and use of the Conveyancers Australia website and its associated referral and information services (collectively, the “Service”). By accessing the website, using the Service, or submitting an enquiry, you agree to be bound by these Terms.
These Terms should be read together with our Privacy Policy, which explains how personal information is collected, used, disclosed and protected when you use the Service.
Privacy Policy: https://conveyancers.com.au/privacy-policy/
2. Nature of the Service
Conveyancers.com.au operates as an intermediary and referral service. We facilitate introductions between consumers and independent third-party conveyancers or legal practitioners.
No Legal Advice: Conveyancers Australia is not a law firm and is not a licensed conveyancing practice. Information made available through the website, our consultants or our published materials is general information and should not be treated as legal, financial or taxation advice.
No Solicitor-Client Relationship: Using the Service does not establish a solicitor-client relationship between you and Conveyancers Australia. Any professional relationship is formed directly between you and the independent conveyancer or legal practitioner you choose to retain, subject to that practitioner’s own costs agreement, engagement terms and professional obligations.
Independent Practitioners: Conveyancers and legal practitioners introduced through the Service operate independently from Conveyancers Australia. Their professional services are provided under separate arrangements between you and the relevant practitioner.
3. Enquiries, Matching and Information You Provide
To provide the Service, we may ask you to submit information about yourself, your property transaction and your conveyancing requirements. You warrant that information you provide is accurate, current and complete to the best of your knowledge.
The quality and suitability of a referral may depend on the information you provide. You are responsible for reviewing the information supplied by any referred practitioner and deciding whether that practitioner is suitable for your circumstances.
4. Contract Uploads and Free Contract Review Requests
The website may allow prospective clients to submit a request for a free contract review and upload documents, including a property contract, through an online form.
Because the existing service model is based on referrals to independent conveyancers or legal practitioners, the precise process for reviewing, transmitting, retaining and deleting uploaded contracts should be confirmed before this clause is published in final form.
Users should not upload documents that they are not authorised to provide. Any personal information contained in an uploaded document will also be handled in accordance with our Privacy Policy.
5. User Obligations and Acceptable Use
You agree to use the website and Service lawfully and responsibly. You must not:
provide information that you know to be false, misleading or materially incomplete;
use the website for an unlawful, fraudulent or abusive purpose;
attempt to gain unauthorised access to the website, servers, systems or information;
introduce malware, viruses, malicious code or other technology intended to disrupt the Service;
use automated scraping, harvesting or similar mechanisms without our prior written permission; or
use the Service in a manner that interferes with its availability, security or proper operation.
6. Fees, Referral Fees and Commercial Arrangements
The consumer-facing referral Service is provided without an upfront fee. Conveyancers Australia may derive revenue from referral fees, commissions, subscription fees or other commercial arrangements with conveyancers and legal practitioners participating on its panel.
By using the Service, you acknowledge this commercial arrangement. Any conveyancing or legal fees charged by an independent practitioner are separate from the Service and are governed by the agreement between you and that practitioner.
The current source document states that referral remuneration does not inflate the conveyancing fees quoted by a referred practitioner. That statement should be retained only if C Conveyancers Australia can substantiate it operationally.
7. Third-Party Practitioners and Services
Any conveyancer, lawyer or other third party introduced through the Service is an independent provider. Conveyancers Australia does not control the day-to-day professional conduct, advice, acts or omissions of an independent practitioner.
You should review a practitioner’s qualifications, pricing, engagement documents and other relevant information before deciding to retain them. Any dispute relating to professional services supplied by a practitioner should ordinarily be addressed with that practitioner, subject to your rights under applicable law.
8. Website Information
We endeavour to keep information published on Conveyancers Australia useful and current, but property, conveyancing and legal requirements may change and may differ between Australian states and territories. Website content is general in nature and is not a substitute for advice tailored to your circumstances.
You should obtain appropriate professional advice before acting on information where your legal rights, contractual obligations, property transaction or financial position may be affected.
9. Privacy and Personal Information
Our collection, use, disclosure and protection of personal information is governed by our Privacy Policy. The Privacy Policy forms an important part of your use of the Service.
The Privacy Policy should also be updated to address the website’s current use of Fluent Forms, uploaded contracts or other files, cookies and similar technologies, and the sharing and retention processes applicable to referral enquiries.
10. Intellectual Property
Unless otherwise indicated, text, graphics, logos, website design, software, code and other proprietary content made available through Conveyancers Australia are owned by or licensed to the Company and are protected by applicable intellectual property laws.
You are granted a limited, revocable and non-transferable right to access and use the website for personal, non-commercial purposes. You must not reproduce, distribute, modify, republish, commercially exploit or create derivative works from protected website content without permission, except where permitted by law.
11. Limitation of Liability and Australian Consumer Law
To the maximum extent permitted by law, Conveyancers Australia is not responsible for losses arising solely from reliance on general information published on the website, interruptions or technical failures of the website, or the independent professional acts or omissions of a conveyancer or legal practitioner to whom you are referred.
Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law or other applicable legislation.
The limitation-of-liability wording in the supplied draft should receive Australian legal review before publication, particularly any proposed limitation or remedy relating to non-excludable statutory guarantees.
12. Indemnity
To the extent permitted by law, you agree to indemnify Conveyancers Australia and its officers, employees and agents against losses, liabilities or reasonable costs arising from your unlawful misuse of the Service, your material breach of these Terms, or information or materials you submit without the necessary authority.
This provision does not require you to indemnify Conveyancers Australia for liability that cannot lawfully be transferred to you.
13. Availability, Changes and Suspension
We may modify, suspend or discontinue parts of the website or Service where reasonably necessary, including for maintenance, security, operational or legal reasons. We do not guarantee that the website will be continuously available or free from errors.
We may also restrict access where we reasonably believe the Service is being misused or these Terms have been materially breached.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes to the Service, our business practices or applicable requirements. The updated version will be published on the website with a revised effective or last-updated date.
Your continued use of the Service after revised Terms are published will constitute acceptance to the extent permitted by applicable law.
15. Severability
If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision will be severed or limited to the minimum extent necessary, and the remaining provisions will continue to operate.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Victoria, Australia. Subject to any rights or jurisdiction that cannot lawfully be excluded, disputes arising in connection with these Terms are subject to the jurisdiction of the courts of Victoria and courts competent to hear appeals from them.
